Is this considered social security fraud?

There is no fraud. The survivor benefits are intended for minor child but the parent has the discretion to spend the money as she or he sees fit and if it was not spent on the child, someone should have called in Social Services at that time. When child is 18, the child benefit ends. There is no issue at hand since child is now 18.
